Agreements for accessing or using the storycompanion.com service ("the Service"). You agree to be bound by all of the Terms of Service.

We reserve the right to modify these Terms of Service at any time, effective upon posting of the modified Terms of Service.

storycompanion.com is providing AI assistance and images. AI companies (e.g., Google, OpenAI, stability.ai, etc.) are third-party service providers and we have no control over their policies, algorithms, accuracy, or bias. We merely pass the data to them, get the result back, and present it. storycompanion.com is not responsible for the accuracy, legality, or ethics of the output provided, including, but not limited to, the accuracy, legality, or ethics of any image generated or edited by the Service.

storycompanion.com may collect and use your data in accordance with our Privacy Policy. By using the Service, you agree to the collection and use of your data by storycompanion.com as described in the Privacy Policy.
2. User Accounts and Subscription Tiers
2.1 Account Creation and Trial
Only the text for "Free Users" (any text project draft) will be permanently deleted after three (3) months.

Storycompanion.com is not responsible for data loss, corruption, payment failures, or other account malfunctions.

Users cannot access the created projects and do not have access to any functionality, except viewing a locked project overview.

All user data will be permanently deleted after three (3) months following the end of the last subscription period.
3. Payment, Billing, & Refunds

All payments are handled by our third-party service provider.

The **subscription period** is one (1) month and is automatically renewed at the end of the current billing cycle.

Upon renewal, storycompanion.com will charge the user's payment method on file. The user will be notified prior to the renewal and has the option to **cancel the subscription at any time prior to the next billing period**.

storycompanion.com reserves the right to immediately suspend or terminate access to the Service for non-payment or breach of these Terms of Service, without notice or liability.

ALL FEES ARE NON-CANCELABLE AND ALL PAYMENTS ARE NON-REFUNDABLE. This includes any unused tokens or credits remaining on the user's account.
4. Acceptable Use Policy and Right to Suspend
4.1 Prohibited Use
You agree not to use the Service or storycompanion.com to create, generate, or transmit content that is:
Illegal, unlawful, violates any applicable local, state, national or international law or regulation.
Infringes upon or violates the intellectual property rights, privacy rights, or publicity rights of any third party.
Promotes or contains sexually explicit, discriminatory, harassing, abusive, or harmful content or materials, including but not limited to, hate speech, threats, or harassment.
Attempts to gain unauthorized access to our systems or network, or disrupt the Service.
Accesses the Service, except as expressly authorized by storycompanion.com, using a method other than the interface and instructions that we provide (e.g. use of automated scripts or web crawlers).
Attempts to reverse engineer or decompile any part of the Service, or otherwise obtain the source code or trade secrets of the Service.
Attempts to create, generate, or transmit content that violates the AUP or the image generation provider's policies.
4.2 Account Suspension and Termination
storycompanion.com reserves the right to immediately suspend or permanently terminate a user's account and access to the Service if:
The user violates any part of this Acceptable Use Policy (Section 4.1).
The user fails to make payments as required by Section 3 (Payment, Billing, & Refunds).
storycompanion.com determines, in its sole discretion, that suspension or termination is necessary to protect the security, integrity, or the rights of other users or third parties.
4.3 Effect of Termination or Suspension
Upon termination or suspension, all rights granted to the user by virtue of these Terms, the user's right to use the Service, and access to all data will immediately cease.
The user will not be entitled to any prorated subscription, subscription amounts, or unused tokens or credits, and all payments are non-refundable.
The user will remain liable for any unpaid fees or charges incurred prior to termination or suspension.
5. Limitation of Liability and Indemnification
5.1 Limitation of Liability
THE SERVICE, INCLUDING ALL TEXT, IMAGE, AND VIDEO GENERATED CONTENT, IS PROVIDED ON AN **"AS IS"** AND **"AS AVAILABLE"** BASIS. STORYCOMPANION.COM EXPRESSLY DISCLAIMS ALL WARRANTIES.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL STORYCOMPANION.COM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
STORYCOMPANION.COM'S TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SERVICE OR THESE TERMS OF SERVICE IS LIMITED TO THE AMOUNT YOU HAVE PAID TO STORYCOMPANION.COM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. **THE MAXIMUM LIABILITY SHALL NOT EXCEED FIVE HUNDRED US DOLLARS ($500 US)**.
5.2 Indemnification
You agree to defend, indemnify, and hold harmless storycompanion.com against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:
Your use of the Service or content.
Your violation of these Terms of Service or applicable law.
Any claim that your use of the AI generated content infringes or violates the intellectual property or other rights of any third party.
Any breach of security or other unauthorized access to the Service caused by your negligence.
6. Governing Law and Dispute Resolution
6.1 Governing Law
These Terms will be governed by the laws of the **Kingdom of Sweden**, without regard to its conflict of law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
6.2 Dispute Resolution (Binding Arbitration)
You and storycompanion.com agree to resolve all disputes through direct negotiation.
If the parties cannot resolve the dispute through direct negotiation within sixty (60) days, the parties agree to submit the Dispute to **binding arbitration** administered by [Arbitration Organization Name, e.g., the Swedish Arbitration Institute (SCC)].
Number of Arbitrators: The place of arbitration shall be Stockholm, Sweden.
Language: The language of the arbitration shall be English.
Judgment on the award rendered by the arbitrator(s) may be entered in any court having competent jurisdiction.
6.3 Judicial Venue
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights or other proprietary rights.
7. Intellectual Property (IP) and User Content
7.1 User Ownership
You retain all of your user content and may use the final output they create, subject to the rights granted to storycompanion.com and its third-party providers.
When you use the Service, you are granting storycompanion.com a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display your user content for the purpose of operating and improving the Service.
8. Modification of Terms, Features, and Prices
storycompanion.com reserves the right to modify or discontinue the Service, these Terms, services, features, and prices at any time without notice.
You agree to accept any changes by continued use of the Service or any refusal to accept the changes is grounds for termination of your account or loss of your subscription rates.
Your continued use after the changes constitutes acceptance of the new Terms.

Security Data: We use Google reCAPTCHA Enterprise to protect our service from fraud and abuse. This
service collects hardware and software information, such as device and application data, and sends it to Google for
analysis.

To provide our content generation features, we send certain data to third-party AI service providers. This may include:
- Text Prompts: Any text you provide for generating marketing copy, slogans, or other text-based content.
- Image Prompts: Any text descriptions you provide for generating images.
- Video Prompts: Any text descriptions or images you provide for generating videos.
We do not send your account information (like your email or payment details) to these AI providers as part of the
content generation process. The information is sent only to generate the content you requested.

- Process your payments and manage your subscription.

We retain your personal data for as long as necessary to provide our Service, fulfill our business purposes,
and comply with legal obligations.

B. Free Trial Accounts

If your free trial expires and you do not upgrade to a paid subscription, we will retain your account
information and any projects you created for **three (3) months** after the trial end date. After this period,
your account and all associated data (projects) will be deleted.
C. Canceled, Stopped, or Failed Subscriptions

If you cancel your subscription, or if it stops due to payment failure, we will retain your account
information and any projects you created for **six (6) months** from the date your subscription became
inactive. This allows you to reactivate and regain access to your work. After this period, your account and
all associated data will be permanently deleted.

Our Service uses cookies and similar technologies (like browser localStorage) to provide its core functions.
